मृत्यु दण्डादेश या आजीवन कारावास का लघुकरण, हर मामले में, जिसमें,-
- (क) मृत्यु का दण्डादेश दिया गया हो, उस दण्ड को अपराधों की सम्मति के बिना भी समुचित सरकार इस संहिता द्वारा उपबन्धित किसी अन्य दंड में लघुकृत कर सकेगी।
- (ख) आजीवन कारावास का दण्डादेश दिया गया हो, अपराधी की सम्मति के बिना भी समुचित सरकार उस दण्ड को ऐसी अवधि के लिए, जो चौदह वर्ष से अधिक न हो, दोनों में से किसी भांति के कारावास में लघुकृत कर सकेगी।
स्पष्टीकरण – “समुचित सरकार” पद से-
- (क) उन मामलों में केन्द्रीय सरकार अभिप्रेत है, जिनमें दंडादेश मृत्यु का दण्डादेश है, या ऐसे विषय से, जिस पर संघ की कार्यपालन शक्ति का विस्तार है, संबंधित किसी विधि के विरुद्ध अपराध के लिए है, तथा
- (ख) उन मामलों में उस राज्य की सरकार, जिसके अन्दर अपराधी दण्डादिष्ट हुआ है, अभिप्रेत है, जहां कि दंडादेश (चाहे मृत्यु का हो या नहीं) ऐसे विषय से, जिस पर राज्य की कार्यपालन शक्ति का विस्तार है, संबंधित किसी विधि के विरुद्ध अपराध के लिए है।

Commutation of sentence of death or imprisonment for life, In every case in which sentence of,-
- (a) death has been passed, the appropriate Government may, without the consent of the offender, commute the punishment for any other punishment provided by this Sanhita;
- (b) imprisonment for life has been passed, the appropriate Government may,without the consent of the offender, commute the punishment for imprisonment of either description for a term not exceeding fourteen years.
Explanation- For the purposes of this section expression “appropriate Government” means,-
- (a) in cases where the sentence is a sentence of death or is for an offence against any law relating to a matter to which the executive power of the Union extends, the Central Government; and
- (b) in cases where the sentence (whether of death or not) is for an offence against any law relating to a matter to which the executive power of the State extends,the Government of the State within which the offender is sentenced.
