कोई बात अपराध नहीं है, जो किसी ऐसे व्यक्ति द्वारा की जाए, जो उसे करने के लिए विधि द्वारा आबद्ध हो या जो तथ्य की भूल के कारण, न कि विधि की भूल के कारण, सद्भावपूर्वक विश्वास करता हो कि वह उसे करने के लिए विधि द्वारा आबद्ध है।
दृष्टांत-
- (क) विधि के समादेशों के अनुवर्तन में अपने वरिष्ठ आफिसर के आदेश से एक सैनिक क भीड़ पर गोली चलाता है क ने कोई अपराध नहीं किया।
- (ख) न्यायालय का आफिसर क, म को गिरफ्तार करने के लिए उस न्यायालय द्वारा आदिष्ट किए जाने पर और सम्यक जांच के पश्चात् यह विश्वास करके कि य, म है, य को गिरफ्तार कर लेता है। क ने कोई अपराध नहीं किया।

Nothing is an offence which is done by a person who is, or who by reason of a mistake of fact and not by reason of a mistake of law in good faith believes himself to be, bound by law to do it.
Illustrations-
- (a) A, a soldier, fires on a mob by the order of his superior officer, in conformity with the commands of the law. A has committed no offence.
- (b) A, an officer of a Court, being ordered by that Court to arrest Y, and after due enquiry, believing Z to be Y, arrests Z. A has committed no offence.
